Who is responsible for processing your personal data?

Asociación Málaga Abraza is the DATA CONTROLLER responsible for processing the USER’s personal data and informs you that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD).

Why do we process your personal data?

To maintain a relationship with the user. The processing operations generally include:

• Sending commercial advertising communications by email, fax, SMS, MMS, social media or any other present or future electronic or physical means that may enable commercial communications. These communications will be carried out by Asociación Málaga Abraza and will be related to its products and services, or those of its collaborators or suppliers with whom promotional agreements have been reached. In this case, third parties will never have access to personal data.

• Carrying out market research and statistical analysis.

• Processing orders, requests, responding to inquiries or any type of request made by the USER through any of the contact methods available on the Asociación Málaga Abraza website.

• Sending online newsletters regarding updates, offers and promotions related to our activities.

• Data collected: Contribution frequency, Amount, First name, Last name, Email, Telephone, Mobile phone, National ID number, Date of birth, How you heard about us, Address, Postal code, City, Province, Country, Bank details (Account holder, Bank account number), Referral (Name, surname, email or phone).

• Legal basis: UNEQUIVOCAL consent through a clear affirmative action by the data subject (Article 6.1.a GDPR).

• Purpose: Management of members and their contributions.

• Retention period: For the duration of the relationship between the user and the Association and in accordance with legal retention requirements.

• Data sharing: Personal data will not be shared with third parties unless required by law.

I WANT TO VOLUNTEER

• Data collected: First name, Last name, National ID number, Date of birth, Preferred language for communication, Location, Telephone, Email, Reason for volunteering with Málaga Abraza, How you heard about volunteering at Málaga Abraza, Programme in which you wish to collaborate.

• Legal basis: UNEQUIVOCAL consent through a clear affirmative action by the data subject (Article 6.1.a GDPR).

• Purpose: Management of volunteers within the Association.

• Retention period: For the duration of the relationship between the volunteer and the Association and in accordance with legal retention requirements.

• Data sharing: Personal data will not be shared with third parties unless required by law.

• Data collected: First name, Last name, National ID number, Telephone, Email, Company name, Tax ID number, How you would like to support us, Comments.

• Legal basis: UNEQUIVOCAL consent through a clear affirmative action by the data subject (Article 6.1.a GDPR).

• Purpose: Management of contributions made to the Association.

• Retention period: For the duration of the relationship between the user and Asociación Málaga Abraza and in accordance with legal retention requirements.

• Data sharing: Personal data will not be shared with third parties unless required by law.

What is the legal basis for processing your personal data?

Processing is legitimised under Article 6 of the GDPR as follows:

• With the USER’s consent: sending commercial communications and newsletters.

• Based on the legitimate interest of Asociación Málaga Abraza: carrying out market research, statistical analysis, and processing orders or requests made by the USER.

How long will we keep your personal data?

Personal data will be retained for no longer than necessary to fulfil the purpose of processing or as required by legal obligations. Once the data is no longer necessary, it will be securely deleted to ensure anonymisation or complete destruction.

Who do we share your personal data with?

Personal data will not be disclosed to third parties unless necessary for the development and execution of the purposes of processing, in which case data may be shared with our communication and training service providers. Asociación Málaga Abraza has signed the confidentiality and data processing agreements required by current privacy regulations with such providers.

What are your rights?

The USER has the right to:

• Withdraw consent at any time.

• Access, rectify, transfer or erase their data and to request restriction of or object to processing.

• Lodge a complaint with the supervisory authority (www.aepd.es) if they consider that processing does not comply with applicable regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

By ticking the relevant boxes and entering data in the fields marked with an asterisk (*) in the forms, the USER expressly and freely accepts that their data is necessary to process their request. The inclusion of data in the remaining fields is voluntary.

The USER guarantees that the personal data provided to Asociación Málaga Abraza is accurate and undertakes to communicate any modifications.

All data requested through the website is mandatory, as it is necessary to provide an optimal service to the USER. If all data is not provided, it cannot be guaranteed that the information and services offered will fully meet their needs.

3. SECURITY MEASURES

In accordance with current data protection regulations, Asociación Málaga Abraza complies with all GDPR and LOPDGDD provisions for the processing of personal data under its responsibility, particularly with the principles described in Article 5 of the GDPR, ensuring that data is processed lawfully, fairly and transparently, and is adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed.

Asociación Málaga Abraza guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and LOPDGDD in order to protect the rights and freedoms of USERS and has provided them with the necessary information to exercise those rights.
